Mental Health
As both in-house lawyers and in private practice, we have dealt with a very wide range of issues in the area of mental health. This has included:-
- Advising, preparing the documentation and representing the local authority on applications under S29 of the Mental Health Act 1983 (MHA)
- Advising on the local authority’s powers and duties under S117 of the MHA.
- Legal issues relating to capacity and compulsory detention
- The care programme approach
- Protection of vulnerable adults
- Advising and representing the local authority on issues relating to capacity,
- Ensuring the local authority’s practice and procedures comply with the Human Rights Act 1998
- Advising on the practice and procedure relating to Mental Health Review Tribunals
- Making applications to and handling cases in the Court of Protection
- Advising on the law, guidelines and policy documents relating to joint working and partnership boards
- Ensuring equality of access and service provision
